Divisare terms and conditions of use

Welcome to Divisare, a Service owned and managed by Europaconcorsi srl, an Internet Services company for architectural design professionals with headquarters on via dei Chiavari 10, 00186 Rome, Italy. Using the Service provided by Divisare (“the Service”), the user accepts the limitations of the following terms and conditions

  1. Description of Service

    Divisare is a Website dedicated to the communication on the Internet of the work undertaken in architectural design schools. Divisare allows the user to create Internet pages where they can publish their work, whether a professor ("courses" and "lessons") or a student ("projects"). In addition, Divisare permits the creation of discussion and collaboration groups (“courses” and “albums”). These functions allow groups of people to communicate via the Internet. The contents of each group are saved by Divisare and it is possible to navigate and search through this information on the Web.

    The Service may be modified at any time by Europaconcorsi srl due to technical or commercial reasons. The Service may be interrupted at any moment by Europaconcorsi srl with reasonable forewarning communicated by the e-mail address provided by the user at the time of registration. Any new functions that expand upon or improve the Service will be subject to the terms and conditions of use.

  2. Modifications to the Terms and Conditions of use

    Europaconcorsi srl reserves the right to modify and update the terms and conditions of use of the existing Service in any moment due to modifications linked to Service distribution methods or adjustments to comply with enforced law. The user can consult the most recent version at any time at the address divisare.com/tos

  3. Registration

    When registering on Divisare, it is necessary to provide data that is complete, accurate and true. During the registration process, the user will be asked to choose a username and password, and the user will be responsible for all of the activities undertaken by that username, as well as the safety of the password.

    Divisare is available only for users eighteen and over. People who are not at least 18 cannot register on Divisare.

  4. Use of materials

    The text, images and other material (on a whole, "Materials") inside Divisare are protected by copyright and other applicable laws.

    Europaconcorsi srl authorizes the user to visualize and download single copies of Materials for the sole purpose of personal use and not for commercial ends. The user may not sell or modify the Materials, or reproduce, visualize, distribute publicly or utilize the Materials, or utilize the Materials in any other form for public or commercial means without the written authorization of Europaconcorsi srl.

    Special rules may apply for the use of specific text, images or other elements provided by Divisare, which will be mentioned when deemed appropriate.

  5. Contents

    • User responsibility.

      The user accepts that all the data, text, informative links to materials and other contents (on a whole, "Contents"), will be distributed to the public and to limited groups; the only responsible person for these contents is the person who originated the contents. This means that the user, and not Europaconcorsi srl, is entirely responsible for all of the contents that are uploaded, published, distributed, diffused or in any other way transmitted(on a whole "Diffused Contents") by the user via the Service. The user acknowledges and accepts that by utilizing the Service they may come into contact with contents that are offensive, indecent or irreprehensible. In no circumstance and for no reason will Europaconcorsi srl by retained responsible for the contents, whatever they may be, including, but limited to, any errors or omissions of the contents, or losses or damages of any kind incurred through the use of the Diffused Contents, including the reliability or accuracy, completeness and utility of the aforementioned contents. The user acknowledges and accepts that the transmission and technical processing of the Service, including its contents, may include transmission on various networks; and modifications for the adjustment and adaptation of technical requirements for the devices of the networks utilized.

    • Rights and responsibilities of the Administration of the didactic group ("Course") and discussion group ("Album") on Divisare (on the whole, "Groups")..

      The Administrators have the supplementary tasks and responsibilities for members and Groups contents. The administration decides if a Group is limited to specific members or accessible to the general public, and the Administration can modify access to a Group at any time. In limited Groups, the Administration decides who can become a member of that Group and who can access or modify the list of members at their personal discretion. The Administration may, at any time, transfer the lead of a Group to another user of Divisare. With regards to the Contents, the Administration is responsible for the management and the Group itself, including the elimination of that same Group, its Contents or archived Contents, at any time at their personal discretion.

    • Rights of Europaconcorsi srl.

      The user acknowledges that Europaconcorsi srl does not implement a preliminary filter, or modify or value the contents rendered available via the Service and does not have any obligation to monitor the Diffused Contents. If Europaconcorsi srl is aware that the Contents seem not to be in conformity with the Terms and conditions of use, Europaconcorsi srl may investigate and in good faith and by its own discretion remove the Contents. Europaconcorsi srl does not have any responsibility in regards to the execution or not of this activity.

    • Archiving and removing Contents..

      If a user is not a Group Leader, they can request the removal of a message they have published and impede the archiving of that same message. The user accepts the direct resolution of eventual contention with third parties in relation to messages published by the user, or they can contact the Group Administrator for requesting removal of the message. For this reason, the user acknowledges and accepts that Europaconcorsi srl does not monitor or control the contents of the information published by third parties, but simply provides a Service that allows users to gain access to the information rendered public through the Website Divisare.

  6. Appropriate behavior

    The user accepts responsibility for their own conduct and communications during utilization of the Service and for all of the consequences of these actions. The user accepts to utilize the Service solely for the publication of their own design work, and if a professor, for the publication of lessons and didactic materials of their own creation. It is not allowed under any circumstances to publish images, text or other material for which the user does not own the copyright. In addition, the user accepts the utilization of the Service for sending or receiving messages that are legal, appropriate and correlated to architectural design and related didactics. As an example, and without limitations, the utilizing the Service the user commits not to:

    • defame, offend, molest, threaten, or in any other way violate the rights (including the right to privacy or advertisement) of others;
    • diffuse or publish contents that are illegal, obscene, illegitimate, defamatory or inappropriate;
    • diffuse contents in violation of patents, trademarks, protected industrial secrets protected by copyright or any other property rights of third parties (the "Rights"), unless the user is in possession of an authorization by the owner to diffuse these contents;
    • diffuse or publish messages that promote pyramid schemes, St. Anthony chains, unsolicited advertising or messages, or any other messages prohibited by the Group Leader.
    • impersonate another person or entity, falsify or eliminate author's credits, legal warnings or ownership, or property designations or labels indicating the origins or source of text, images or other material contained in a deposited file;
    • limit or impede other user’s utilization and enjoyment of the Service;
    • utilize the Service for any unauthorized or illegal ends;
    • remove notices related to copyright or other ownership rights of contents or related Services;
    • utilize robots, spiders, data search and recovery applications from sites to recover or index parts of the Service or to gather information about users for any unauthorized scope;
    • create user accounts through automated means or under false pretenses;
    • promote or provide information containing instructions for the undertaking of illegal activities or incitement of physical damages against groups or people; or
    • transmit viruses, worms, defects, Trojan horses or any other destructive elements.

    The users accept the enforced laws and procedures relating to online conduct and acceptable Internet contents, including regulations that govern the importing and exporting of data from and to the user's country of residence.

    While Europaconcorsi srl prohibits these behaviors and contents in respect to the Service, the user acknowledges and accepts that they are exposed to behavior and/or contents of the site at their own risk.

    The user must communicate to Europaconcorsi srl any conduct that is illicit, offensive, insulting, obscene or damaging, (conduct which, for example, incites racial discrimination) by sending a message to

      Europaconcorsi srl is and remains the exclusive owner of the rights to the Service. The user acknowledges and accepts that the Service may contain and utilize confidential information, as well as laws pertaining to intellectual property and other current laws. Unless expressly authorized by Europaconcorsi srl, the user cannot copy, modify, publish, transmit, distribute, execute, demonstrate or sell any of the information owned by Europaconcorsi srl. "Divisare", the logo "Divisare" are trademarks owned by Europaconcorsi srl.

    • User rights

      Europaconcorsi srl does not claim any property rights or control over the contents that are uploaded, published or visualized by users through the Service. The user or the third party license holder according to the situation, reserve the copyright on the Contents uploaded, published or visualized by the user or through the Service, and the user is responsible for the protection of these rights. Uploading, placing or visualizing Contents to or by way of the Service, the user concedes a free license to Europaconcorsi srl, not exclusive and at a worldwide level for reproduction, adaptation and publication of these Contents on the Service for the sole purpose of visualizing, distributing and promoting the Service or other Services of Europaconcorsi srl. This license terminates when the contents in question are eliminated from the Service. Europaconcorsi srl reserves the right to publish the Contents that have been uploaded, published and visualized by the user on or through the Service and to utilize these Contents in relation to other Services offered by Europaconcorsi srl.

  8. General practices relating to the use and saving of information

    The user acknowledges and accepts that Europaconcorsi srl does not have any responsibility for the elimination or the failure to save the contents managed or diffused by the Service, except for fraud or grave damages. The user acknowledges and accepts that Europaconcorsi srl has not defined a maximum number of transmissions that the user may send via the Service or the quantity of space on the disc used; nevertheless, Europaconcorsi srl reserves the right, at its own discretion and for justified means to introduce limits at any time without forewarning.

    Divisare is a Service that is supported by announcements. Therefore, announcements and promotions are visualized in the Service. The modality, terms and levels of announcements visualized in the Service can be subject to modifications. The user acknowledges and accepts that any type of consequence from these activities or from the presence of these insertions in the Service.

  11. User privacy

    The user acknowledges and accepts that Europaconcorsi srl may access, conserve and reveal their personal data and contents of their account if requested to do so under the law or in good faith conserve or reveal this access data if necessary for legal proceedings or to protect the rights, property and/or security of Europaconcorsi srl. The personal data gathered by Europaconcorsi srl may be memorized and processed in Italy or in any other country in which Europaconcorsi srl has its offices. By utilizing the Service, the user consents to any type of data transfer outside of their country of residence.

  12. Exonerative clause

    Europaconcorsi srl declines any responsibility for accuracy, contents, completeness, legality, operative reliability or availability of the information and contents visualized in the Service. Europaconcorsi srl declines any responsibility for the conduct of the user and for the conduct of others that use the Service. The users accept use of the Service at their own risk.

  13. Indemnity clause

    The user accepts to maintain Europaconcorsi srl undamaged and not answerable to any eventual risks from damages resulting from third parties deriving from or in any way correlated to the illicit use or use that is in violation of these regulations of the Service, including any responsibility or expense stemming from retaliations, losses, damages (effective or subsequent), judicial proceedings, court cases, legal controversies, costs and dues of any nature.

  14. Limitations of responsibility

    In no case will Europaconcorsi srl be retained responsible for damages or consequences to the user stemming from the improper use of the Service. These limitations of responsibility are applied to damages stemming from the improper use and reliance on the Service, from the impossibility to use the Service, to its interruption, suspension or cessation (including damages sustained by third parties) and any possible failure related to the essential scope or any limited repairs up to the maximum amount consented by law.

The user may immediately cease to use the Service at any time, for any reason, by sending an e-mail to customer assistance at the address .     The intellectual property rights of Europaconcorsi srl, the warranty exemptions, the damages and limitations of responsibility extend beyond this cessation.

  17. Disputes and competent courts

    The terms and conditions of use contained in this document are governed by Italian law. For any controversies between parties, the competent court is that of the city of Rome.
